Civil litigation differs from criminal law in that legal action is initiated by a plaintiff rather than the state. The civil litigation process includes pre-trial procedures, court representations, cost assessments, and the enforcement of judgments.

Civil litigation matters are handled in either the Magistrate’s Court or the High Court, depending on the monetary value of the claim. These cases often involve claims related to contract enforcement, commercial disputes, and debt recovery.

The Litigation Process for Debt Recovery

Legal action for debt collection should always be considered a last resort. Before pursuing litigation, a creditor should first attempt to negotiate a repayment arrangement with the debtor.

If the debtor fails to honor the arrangement, the creditor may be required to take further action, including handing over the matter to a debt collection attorney for enforcement.

When to Handover an Overdue Account to an Attorney

Under the National Credit Act (NCA), a creditor may initiate legal proceedings after 20 days of non-payment, provided the correct procedures are followed.

  • Section 129 Notice – The creditor is legally required to inform the debtor of the intent to initiate legal proceedings and advise them of their right to seek assistance from a debt counselor.
  • Debt Review – If the debtor fails to apply for debt review within 10 days, the creditor may proceed with legal action.
  • Debt Review Restrictions – If the debtor has applied for debt review, legal proceedings cannot be initiated unless a court or debt counselor determines that the debtor is not over-indebted.
